Terms of Use

1. Acceptance

By accessing or using Cane Planner (the "Platform"), you agree to be bound by these Terms of Use. The Platform is provided by Tongaat Hulett Zimbabwe for authorised users only — outgrower farmers, mill employees, and contracted operators.

2. Authorised Use

The Platform is for legitimate agricultural and mill operations only. You agree to:

• Use the Platform only for its intended purpose (cane supply management, gate passes, plant operations, scheduling)
• Keep your login credentials confidential and not share them
• Provide accurate information when entering data (field sizes, cane tonnage, delivery records, quality readings)
• Report any suspected security breaches immediately

3. Prohibited Conduct

You must not:

• Submit false or misleading data (fraudulent gate passes, inflated tonnage, fake burn notices)
• Attempt to access another user's account or data
• Use automated tools to access the Platform (bots, scrapers)
• Attempt to circumvent security controls or access restrictions
• Use the Platform for any unlawful purpose

Violations may result in account suspension, forfeiture of allocations, and referral to appropriate authorities.

4. Data Accuracy

You are responsible for the accuracy of data you enter. The Platform uses your data to calculate allocations, quality scores, and trust ratings. Inaccurate data may result in incorrect allocations, forfeitures, or compliance issues.

5. Notifications

By using the Platform, you consent to receive operational notifications via push notification, SMS, WhatsApp, and email. These are essential for cane supply coordination and cannot be fully opted out of while your account is active. You may adjust notification preferences in your profile settings.

6. Intellectual Property

The Platform, its software, design, and content are the property of Tongaat Hulett Zimbabwe. You are granted a limited, non-transferable licence to use the Platform for its intended purpose.

7. Availability

We strive to keep the Platform available 24/7 but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance. We are not liable for losses arising from downtime or system failures.

8. Account Termination

Your account may be suspended or terminated if you violate these terms, leave the employ of Tongaat Hulett, or if your grower agreement ends. Upon termination, your access is revoked but data is retained per our retention policy.

9. Limitation of Liability

The Platform is provided "as is". We are not liable for losses arising from reliance on data displayed in the Platform, including but not limited to allocation calculations, quality scores, or scheduling information.

10. Changes

We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance. Material changes will be notified via the Platform.

11. Governing Law

These terms are governed by the laws of Zimbabwe. Any disputes shall be resolved in the courts of Zimbabwe.
